Website Build + Care Plan Terms
These terms apply when you buy a website from Kropf Concepts LLC ("we", "us"). If we also sign a separate written agreement with you and it conflicts with these terms, the signed agreement controls.
- What you're buying. A custom website for your business: the pages and features shown in your preview or quote, a lead form, a privacy page, connection to your domain, and launch. Two rounds of changes before launch are included. Not included: an online store, a booking system, ad or SEO campaigns, email hosting, a logo, photography, and paid third-party tools.
- Price. $750 one time for the build. That is the whole required cost — hosting is optional. If you want us to host the site and look after it, the Care Plan is $49 per month, opt-in only: it starts just if you choose it and renews monthly until you cancel. If you don't take it, we hand over your files and you host the site wherever you like. No late fees and no interest. Any extra work is quoted before we do it. Sales tax, if due, is shown on the invoice.
- Refunds. If you're not satisfied before your site goes live on your domain, we refund your $750 in full. Once the site is live, the build fee is non-refundable. If you took the optional Care Plan, monthly payments already made are not refunded.
- Cancel anytime. Email karl@kropfconcepts.com (or call or text (479) 214-0436 and we'll confirm by email). Charges stop at the end of the current paid month. No fee, no minimum, no penalty. We confirm within 2 business days. Any price change gets 30 days' notice, and once a year we remind you of your plan and how to cancel.
- You own your site. When the $750 is paid, Kropf Concepts assigns you the copyright in the custom site we built for you, and we confirm that in a signed email. We keep our reusable tools and give you a permanent license to use them in your site. Fonts, stock photos and open-source code stay under their own licenses, listed in your handover. Your content stays yours. We may show your site in our portfolio unless you tell us not to.
- Your domain is registered in your business's name, so you own it.
- The Care Plan includes hosting, SSL, uptime monitoring, lead alerts, a monthly test lead, up to 30 minutes a month of small edits, a monthly report, quarterly checks, backups, and domain renewal reminders.
- If a payment fails: we send a reminder, then a written notice giving you 10 days to pay. No earlier than day 45, and after 3 more days' notice, hosting may be paused with a neutral page. We never delete your site to collect, and paying restores it. For 30 days after a pause or cancellation you can get a full copy of the site files you own.
- Leaving. Within 5 business days of your request, we send your files and help you move hosting and DNS.
- Your part. Content you send us (text, photos, logos, prices, claims about your business) is yours or used with permission, and it's accurate. You approve the review quotes we show. You tell us before adding tracking pixels or a texting program. You follow the review rules: no fake, paid, or "happy-customers-only" reviews. If someone makes a claim against us because of content you supplied or approved, you'll cover our reasonable costs of that claim.
- Reviews. We quote real Google reviews word for word, with the reviewer's name and a link, and remove any on request. We never write or edit reviews.
- Our promise. Competent, workmanlike work, and we fix what we built if you tell us about a problem in writing. We don't guarantee rankings, leads or results, and we don't promise ADA or other legal compliance (we build to WCAG 2.2 AA accessibility guidelines in good faith). Otherwise the site and services are provided "as is," and all other warranties, including merchantability and fitness for a particular purpose, are disclaimed.
- Limit of liability, including for our negligence. Our total liability is capped at the fees you paid us in the prior 12 months. We are not liable for lost profits, lost leads, missed form emails, or indirect damages. This limit doesn't apply to gross negligence, willful misconduct or fraud.
- Privacy. Leads from your site belong to you. We keep a delivery copy only to confirm delivery and report to you. We never sell it. See our Privacy Policy.
- Arkansas law. If there's a dispute, we'll first try to work it out for 30 days. After that, the courts of Franklin County, Arkansas (or small claims court) handle it, to the extent the law allows. The winning side may recover reasonable attorney's fees.
- Outside services. Your site relies on outside providers (hosting, domain registrars, email and payment services). We're not responsible for their outages or changes, but we'll work to restore your site as quickly as we reasonably can.
- Whole agreement. These terms (plus any signed agreement or written quote) are the whole agreement. Changes must be in writing, and email counts. If any part is found unenforceable, the rest still applies. If we update these terms, the new version applies to renewals only after 30 days' notice to you.
- Electronic agreement. You agree to do business electronically. Checking the box at checkout is your signature on behalf of your business, and you confirm you're authorized to sign for it.
